US Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without legal authority.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his repatriation to the United States to face human smuggling allegations, he was detained in federal custody.
In her order, the judge noted that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Context of the Case
The court challenge involve disputed claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a separate trial in Tennessee.
Conditions of Freedom
The judge, who was hearing his challenge to deportation in a Maryland district court, ruled that he must now comply with the conditions of his bond from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This decision represents a notable development in a complicated immigration battle involving claims of mistaken imprisonment and contested gang associations.
