In a unsigned ruling, the nation's top court cleared the way for Texas to employ a redrawn congressional boundary scheme that is projected to include as many as five new conservative-tilting districts. The six-to-three order, released on Thursday, grants a petition by the state to set aside a federal judge's ruling that had struck down the redistricting plan in November.

Justices' Explanation

The federal judge improperly inserted itself into an ongoing primary campaign, creating significant confusion and disrupting the sensitive federal-state balance in elections, the justices wrote in detailing its decision.

The federal court had previously found that Texas had probably classified voters according to their race – a act known as illegal race-based districting – when it enacted the new maps. It had mandated the state to use the maps established after the last decennial survey for the upcoming election.

Strong Dissenting Opinion

Through a sharply worded dissenting opinion, Justice Elena Kagan objected to the court's action. She stated that it disregarded the work of the lower court, pointing out that its ruling was actually authored by a judge selected by former President Donald Trump.

Our position is above the district court, but our capability is not greater for resolving such fact-driven issues, Kagan wrote in a dissent supported by Justices Sonia Sotomayor and Ketanji Brown Jackson.

The justice went on, The majority's order solidifies that Texas's new map, with all its boosted political tilt, will control next year's elections. And it means that many Texas residents, for no good reason, will be grouped in electoral districts due to their race. And that result, as this court has declared year in and year out, is a breach of the law of the land.

National Redistricting Battle

The court's action is part of a national contest over the redrawing of electoral maps. Texas is a key piece in campaigns to transform the U.S. House map to bolster a fragile Republican majority. Typically, redistricting takes place after a new decade's census. Yet the action by Texas Republicans to move ahead with a bold mid-cycle redistricting earlier this year triggered a series of events among other states.

Conservative legislators in states like North Carolina and Missouri have also enacted new maps that are estimated to yield a number of additional conservative seats. The opposition, meanwhile, have responded with revised boundaries in including California and Virginia, which could offset those potential gains.

Political Reactions

The Texas attorney general welcomed the High Court's decision. In a release, he said the order protected Texas's prerogative to draw a map that secures electoral outcomes supportive of his party. Texas is paving the way as we take our country back, district by district, state by state, he remarked.

On the other hand, opposition party leaders decried the ruling. It's incredibly disappointing that the Court has rubber stamped a map enacted by Texas Republicans which, simply put, is an extreme, racially gerrymandered map, said the leader of a major party election organization.

A leading House leader said the court had yet again shredded its legitimacy by approving a race-based map. Tonight's ruling by far-right justices on the supreme court is further proof that the extremists will do anything to rig the midterm elections. The gerrymandered Texas congressional map is a partisan and racially discriminatory power grab designed to subvert the will of the voters – particularly in Black and Latino communities, he stated.
